required for the use of a unisex bathroom as kong as it is acceptable to the
local plumbing inspector. However, the design of the bathroom does not meet our
regulations. The petitioner must resubmit a plan of the unisex bathroom
adjacent to the Justin Morgan Room, showing full compliance with Section 30.
The petitioner testified that the hotel was built in 1926 and from that time
little had been done to make the Hotel accessible. The architects were
confronted with a large building with various levels containing lobbies„
function rooms, restaurants, lounges and entries. The specific problem is
accessibility in the Coolidge Cafe. Two different means of accessibility to the
three existing levels of the Cafe was proposed to the Board. The upper level,
(Level L) would be accessible from the main lobby and the Wiggins entry via a
new lift. The lower two levels would be accessible via a new entrance from the
southeast corner. The two areas would not be accessible inside but would be
tied by the exterior patio and lift. After reviewing the testimony presented,
the Board voted to GRANT the variance to the inside. The variance is further
conditioned upon appropriate signage being.
This constitutes a final decision of the Architectural Access Board
entered pursuant to G.L. c. 30A. Any aggrieved person may appeal this
decision to the Superior Court of the Commonwealth of Massachusetts
pursuant to Section 14 of G.L. c. 30A. Any such appeal must be filed in
court no later than (30) days of receipt of this decision.
