3.3.6 No alteration of existing building or facility shall impose greater accessibility than
that which would be required for new construction.
Transient Lodging Facilities
8.1 Transient lodging facilities shall comply with 521 CMR.
8.2 Public and common use areas shall comply.
8.2.1 Public areas relevant to this building include:
Public entrance
Corridors to accessible guest unit
Vending area and public telephone if provided.
8.4 The minimum number of accessible units shall be 5%of the total units but not less
than one.
The Gothic Garden will have one accessible unit on the first floor of a
total of seven units in the building to comply with this requirement.
Note:
In applying the 5%rule to facilities which consist of more than
one building,all of the units in the entire facility shall be added
together. The existing hotel has 99 guestrooms. Of these,6
units are accessible. One accessible unit has a roll in shower.
8.4.1 Distribution
The range of equivalent guestroom options shall be dispersed proportionately
among the classes of accommodations available. The Gothic Garden will have
one accessible unit:on the first floor that has more than the equivalent amenities of
the other six units.
8.4.4 The Hotel must provide one additional roll in accessible shower unit in the facility
to comply with the quota required by 8.4.4.
8.4.5 The Hotel must make the new accessible unit in the Gothic Garden comply with
Table 8.4.5 for the hearing impaired.
8.5 Minimum requirements for accessible units:
The accessible unit will be on an accessible route on the first floor. This
unit meets the minimum requirement for the number of units required by
521 CMR.
8.5.2 Elevators: An elevator is not required in a transient lodging facility that is less
than three stories in height or less than 3,000 square feet per story if all rooms are
proportionately distributed in accordance with 521 CMR 8.4.1 and all public
spaces are accessible.
The first floor accessible unit is on an accessible route,is equivalent to the
distribution of rooms and is accessible to public facilities.

Dear Tony,
Enclosed, please find a review of 521 CMR Architectural Access Board in regards to the
question on the need for barrier free access above the first floor for the proposed renovations
to the Northampton Hotel building on Gothic Street. Based on the estimated cost of
construction versus the value of the building,the new work will have to be in full compliance
with the requirements for new construction for a transient lodging facility. Paragraph 8.5.2 of
521 CMR states that"An elevator is not required in a transient lodging facility that is less than
three stories or that has less than 3,000 square feet per story, if all rooms are proportionally
distributed in accordance with 521 CMR 8.4.1 and all public spaces are fully accessible".
The conclusions of the attached review comply with this criteria and therefore the renovation
of this building as an annex to the Northampton Hotel facility does not require barrier free
access to the second floor to meet the intent of the Code.
