Dear Mr. Clark:
My wife and I have recently moved to 63 Golden Drive in
Florence. I have just learned that a contractor is planning
to build a home on the lot adjacent to mine. I am writing
to document my concerns .
Specifically, this lot is very wet. Consequently, certain
problems must be addressed in any proposed building plan:
(1) Any home going up will be threatened with a serious
water problem. The contractor who is planning to build
did not even anticipate filling in the property. Who
will be liable for the problems that may ensue?
(2 ) I am concerned that if the builder redesigns the
landscape to alleviate the water problems on this lot,
he will create problems for my house. Thus far, I have
not experienced any water difficulties , and I want to
keep it that way.
(3) A neighbor's home is situated topographically similarly
to the lot in question. In order to compensate for the
water, he is said to "have spent a fortune" and also that
he "has more piping outside the house than inside ."
(4) During the last couple of weeks , a naturally occurring
waterway has been flowing on the property. What is the
legality of tampering with this?
