Hi Carol,
Boy, I don't know who to talk so thats why I keep going back and forth so nobodys left out. Again, I
went out and measured my and Jims side boundary from there monument.This time stuck a pin in.1 then
went across 15 ft from that and stuck another in.l don't know if Dave told you about the 15ft from the
engineer or not. If not he can tell you or I will. From there measured 102 across and stuck another one.
This way everything is connected to where it should. Ya know. I also went out front and started at the pin
at the telephone box and measured 102 on an angle up over the pool to see where it ended up. I left it
there incase you guys wanted to see it Anyway to end this story if everyone wants to get together and
check the measurements we can. Then hopefully we can be on the same page and stop measuring. The
one over the pool may be off a tad because of course in that one spot it couldn't stay on the ground.If we
can all agree the others are right my thought is
after the pool is down we see where the one over the pool lies exactly and then we should be fine. You
can keep this for Dave or when I see him I can tell him what I did. I also wanted to let you know just so we
all stay up to date and we can stop measuring this crap. Boy, I feel like a broken record.Any way let me
know.

I just wanted to let you know that I ran a string so I could try to U d-reo to make a Garden
on the side of the garage with Cam.tGnda back to the other message. nl C tf om the comer of
our garage straight across toward your house to the string.The sting may not be perfect but as good as
can be because of the pool.1 would like to place a couple things this weekend that he grew in school

to see if we can try to straighten the line out a bit.We can trade a couple feet in the front for the back.Not
sell or anything.lt could be in writing if you wanted or not, I dont care. I think even if you or I sold these
houses it would be a selling point to have a straighter fence line and in the mean time we both have a
nicer more usable space.) highly doubt anyone would make a fuss about it if it betters the
spaces.Especially since its such a drastic angle'If they did they would have to be crazy.Who wants a nutty
angle in there back yard that leaves them with a comer in the back that is highly unusable for alot of
things.We could just go to the telephone
box or whatever I am willing to chat about it. We can talk about it if you want to. Just wanted to email you
so you can think about it.l think it would be nicer for both of us.What do you think?

First off I said I was not saying that they were incorrect. I was telling you what happened.You
sound mad already and I specified that I just want it a done deal but also right for everyones sake. I am
telling you what Kathryn said to me at Holmberg, that the pins could be off 1 or more feet and that it was
an approx not a dead on survey the way it was done. I didn't expect the other lady Fri to say anything that
she did. I just simply wanted to get the other side of the road done. 1 told you guys months ago that I was
talking to them about this so thats why I called them back not to check on you. I called them to do our
other side like I told you I wanted to do so when things are moved they will be moved once. I understand
the whole concept of getting your land. She also told me that what I wrote in your other email I sent you
was the right way of doing it I did just go out and do that and the pin they posted is 4ft off. So she was
right that it was an approximate
done. I measure 23 feet over from the existing pin 23+ 102.05(mine)= 125.05 Jim and Sharons property
is 125.00. Carol I don't want to argue this ok I like you, want to do it, get it right, move what needs to be
moved, and stay civil neighbors/friends what ever you consider us. 1 thought we were all friends and are
adults so why argue. I just wanted to let you know what they said.You can call me back if you would

we had done Friday is not accurate?and that you are disagreeing w/the survey? If so, then I would
suggest that you call Homberg to locate your pins and see what they come up with.
In hiring Homberg to place our pins it was discussed that the accuracy would be depending on how many
point they were able to find on the property. They were able to locate the two pins on the opposite side of
our property and measured the rest. I am sure that wether the new pins are a foot or less off from the
property line, the fact remains that a large portion of your pool is still on our property.
We don't want to make this into a battle either but I will do whatever I have to make sure the land goes
back to my mother.

I called Homberg Fri to see if they could come over and do our corner in the back by the road.The
lady I spoke to acted really weird to me about how the survey was done. She told me she had to look into
it and would call me back today. What ever that meant.lnstead of waiting I called back today because I
just want to get this craziness out of the way and do what we have to all do.Ya know. So the lady I spoke
to today gave me prices for what we want to have done in the comer and told me that just doing the line
down the middle can be a foot or two off. Of course. So now what?I know I definatly don't want to fight
about this issue. That would be stupid. I just want us talk and get it over with. Can we figure something
and talk real soon please. The only nights I have free this week is Thur,Fri. Unless you want to do it earlier
in the day.

Dear Mr. St. James,
I am replying to your letter dated December 8, 2005. At this point I don't feel
comfortable signing this letter. I am not disputing the survey done in the year 1969 but as
of now we don't have any property pins to accurately say where the boundary line is. On
December 11,2005 Shirley, Dave, Carol,Brian and I sat down and discussed the issue.
We have all agreed that we are going to work this out between the families. I spoke with
Carol and Dave December 12,2005 and they told me they were going to have the
property surveyed so we can have property pins to go by.

Dear Tracy,
This letter is to inform you that I had given the previous owner Myrtle Svoboda of your
property located at 324 Acrebrook Drive Florence Ma(see attached copy of registry of
deeds lot 141)permission to put the fence in question in its current location.
After you had illegally put a pool on my land, my daughter had the land surveyed and
new pins were staked in the ground by Howard Eaton Assoc. Inc., on April 19, 2006. The
new pins surveyed and set at boundary line were the same as the original in 1969.
My attorney William St. James sent you a letter dated December 8, 2005 to have the pool
deck and fence you put on my land in 2005 to be removed by April 30, 2006. At which
time you sent a letter to my attorney again requesting the property be surveyed.
I decided to keep this out of court and gave you permission to keep the pool and deck up
for the summer of 2006
This letter is now to inform you that I give you until September 1, 2006 to remove your
pool deck, pool, fences and any other items put on my property and return the land back
to its original state.
Attached are emails and letters sent between my daughter Carol and you to remind you of
your agreement to remove these items as soon as the land had been surveyed which again
was done April 19, 2006.
