Notice of Appeal
An appeal from the decision of the Planning Board may be made by any person aggrieved pursuant to MGL Chapt. 40A, Section 17 as
amended within twenty(20) days after the date of the filing of the notice of the decision with the City Clerk. The date is listed above. Such
appeal may be made to the Hampshire Superior Court with a certified copy of the appeal sent to the City Clerk of the City of Northampton.

10. The plans shall show a separate water service and meter is required for each unit if owned
separately or a single meter in an accessible common space if there is a homeowner's or other
condominium association or if these are rental units with a single property owner.
11. The information shown on plan sheet and all of the other plans shall be incorporated into the
Grading & Utility Plan so that there is a single clear plan sheet showing how the site is being
developed. The revised plan shall be at a sufficient scale that all of this information is clear.
12. The 2%"caliper shade trees shown on plans shall be drawn from list of acceptable trees in the
Northampton Subdivision Regulations. All trees and shrubs shall be identified on the plans in
sufficient detail that it is clear that they comply with the regulations.
13. Dig safe approval is required for all plantings and DPW approval for all,plantings within the right-of-
way. Plans shall be revised as necessary to ensure the same level of planting with what minor
relocations are necessary to avoid conflicts with public and private utilities.
14. The applicantldeveloper shall pay the cost of any on-street no parking signs installed by the
Department of Public Works when the curb is restored.
15. The plans shall document that the lighting'fixtures comply with the Zoning's lighting standards.
16. PRIOR to the issuance of a Building Permit for the property submit to the Office of Planning and
Development(OPD), for OPD approval consistent with these permit conditions, a revised version of
the "Grading& Utility Plan,"signed and stamped by a landscape architect or engineer, reflecting all of
the permit conditions contained above. Said changes shall be shown on a revised version of the
"Grading&Utility Plan-The Creamery, 283 Prospect Street"dated March 25, 2009, signed and stamped
by Peter Wells, RLA, and updated with hand draw markings by the applicant on or about April 1, 2009,
17, PRIOR to the issuance of a Certificate of Occupancy for the property develop all the site

work space, although not necessarily in the same unit.)
FINDINGS:
The Planning Board granted the Site Plan for the conversion of use to 5 live-work spaces based on the information submitted with the
plans.
In granting the permit to construct the live-work spaces, the Board found the following applicable standards within 11.1 were met:
1. The requested use protects adjoining premises against seriously detrimental uses.
2. The requested use will not have an effect on convenience and safety of vehicular and pedestrian movement within the site and on
adjacent streets, roads in the area. The wide curb cut will be closed along Prospect Street improving pedestrian safety on the sidewalk,
All vehicles will be directed from Murphy Terrace improving safety.
3. The requested use will have a positive relationship of structures and open spaces to the natural landscape, existing buildings and
other community assets in the area because the renovations will result in a net gain of open space and reduction in trips.

4. The requested use will not overload, and will mitigate adverse impacts on, the City's resources
including the effect on the City's water supply and distribution system,sanitary and storm
sewage collection and treatment systems, fire protection, streets and schools. No city services are required,
5. The requested use meets any special regulations set forth in the Zoning Ordinance in section 350-11

Convert Buildings to 5 five/work spaces.
HARDSHIP:
CONDITION OF APPROVAL
1) There shall be at least one parking space dedicated per Mixed Residential/Work Space unit(including
the garage spaces). Ali of the garage spaces must be dedicated for vehicle parking and may not be
converted to other uses. There shall be a total of nine parking spaces(four in the garage and five on
the site).
2. The entire curb line along Prospect Street and Murphy Terrace shall be replaced with vertical granite
curb, in accordance with the Northampton Department of Public Works(DPW)standards for such
curbs and with a DPW Trench Permit and DPW Driveway Permit.
3.The entire sidewalk along Prospect Street shall be a cement concrete sidewalk in excellent condition
and the tree belt between the sidewalk and the street shall be foamed and seeded, in accordance with
standards for sidewalks in the Northampton Subdivision Regulations and DPW standards for such
sidewalks.
4.No living space of any kind shall be developed on the first floor of the units in the brick building,
consistent with Northampton zoning which requires that the residential component be above the first
floor. In the wood frame building on the corner-of Murphy and Prospect, which fits as a single family
home in the neighborhood, residential uses may be allowed on the first floor.
5. There shall be no parking space within five feet of the Murphy Terrace right-of-way line.
6. No snow storage from the parking fot and driveway shall be allowed(or shown on the plans) within
ten feet of any abutting property or within the city right-of-way.
7. The plans shall show the two existing waterlines, based on the information available from the Water
Department tie cards, and the abandoned 4"lateral sewer along the east side of the property from
Prospect Street to 11 Murphy Terrace.
8. There shall be no EIFS or Dryvit used in the building exteriors.
9, The plans must show a design for addressing parking tot and building gutter drainage, stamped by
a professional engineer, that will mitigate an),new drainage and will reduce storm runoff by putting at
least some of the drainage underground.
