re: Occupancy Permit for parcel ID 25-055-001
Dear Ms. Baird,
I have reviewed the documentation concerning the above named property. The tax assessor's
records indicate the structure was constructed in 1955. Neither the tax assessor's or building
department's records show any work being completed since 1972 when building documents became a
requirement. Therefore, I conclude that in accordance with CMR780 Chapter 1, which has contained
language consistent with R102.7 as shown below since the inception of Massachusetts Building Codes
that the structure in question can be legally occupied without an occupancy permit.
R102.7 Existing structures. The legal occupancy of any structure existing on the date of adoption of
this code shall be permitted to continue without change, except as is specifically covered in this code,
the International Property Maintenance Code or the International Fire Code, or as is deemed necessary
by the building official for the general safety and welfare of the occupants and the public.
