Vapor retarders.Although these are still in the code have exceptions, one must understand that there is a difference between a vapor retarder or barrier and an air barrier.An air barrier is intended to stop air flow(convection)a vapor retarder or barrier is intended to stop molecular moisture transfer(diffusion). A vapor retarder or barrier is effective even if there are some holes or gaps, however an air barrier has to be absolute and complete. If air can leak through an electrical device or through a crack it follows the path of least resistance and carries 99%of the moisture in a structure.This is evident every time one exposes fiberglass insulation and finds black insulation, which is dirt filter out of the air moving through the insulation. 780 CMR R601.2 for vapor retarders and Table N1102.4.2 for air sealing requirements. 35. Unvented attic assemblies. Hot roofs are allowed, but have specific requirements 780 CMR R806.4. 6. Foundation anchor bolts must be%2" and be embedded a minimum of 7" into the concrete. 10" bolts! 780 CMR R403.1.6 7. All windows in a hazardous locations requires them to be tempered the following are locations which appear to need tempering. a. All doors and sidelights. 2. Stamped structural drawings are required for all none code prescriptive framing. Some examples are -joist, LVLs,floor or roof truss. 3. All point loads must have continuous load paths to appropriate bearing. 4. The center sonotubes for both the deck and front porch require minimum of one sqft of bearing 16" diameter at the bottom. 5. All thermal plastics have to meet the requirements of R316.1 6. Sister all 2nd floor joist above the dining room and kitchen. 7. Remover lath to install fire blocking. 8. Reinsulate all exterior walls with cellulose.Add 1" ISO on exterior or interior. 9. Decks and porches greater than 30" AFG require guard rails. 10. Steps with four or more risers require rails. 11. Mechanical contractor must take a sheet metal permit and provide; Manual J, Line drawings of HVAC system, Equipment specifications before beginning work. Note September begins the newest energy code 2012 IECC with MA amendments with an expectation that the new Stretch Code will be available at that time.These codes will likely have a 6 month concurrency period which effectively pushes the change back to July 2014. As of August 4th 2011 the 8th Edition MA code is the 2009 IRC with MA amendments. In the following are some generic requirements which seem to be problematic. This is not intended to be comprehensive, nor is it a substitute for purchasing and reading the MA codes. Grading plan for structures being constructed required. 780 CMR R401.3 for drainage requirements. 3. A basement drainage system is required in all basements 780 CMR R405.2.3. except those in group I soils(table R405.1) 4. Foundations that retain earth and enclose interior space require damp proofing 780 CMR R406.1. 5. As soon as you get a plumber and an electrician to take out permits, and after you meet with Charles Miller to discuss specifics of the job, we will remove the stop work. Per the city's zoning ordinance, the permit fee for the job will be doubled because work started before the permit was issued, and the fee for removing the stop work order is $50.00. The additional cost will be $638.00. I've reserved time on Wednesday morning for a meeting with Mr. Miller. Call the office if you have any questions. The provisions of the second paragraph of section three A of chapter one hundred and thirty-nine, relative to liens for such debt and the collection of claims for such debt, shall apply to any debt referred to in this section, except that the local inspector shall act hereunder in place of the mayor or board of selectmen. During the time such order is in effect it shall be unlawful to use or occupy such structure or any portion thereof for any purpose. Section 10. An owner, lessee or mortgagee in possession aggrieved by such order may have the remedy prescribed by section two of chapter one hundred and thirty-nine; provided, that no provision of said section two shall be construed so as to hinder, delay or prevent the local inspector acting and proceeding under section nine; and provided, further, that this section shall not prevent the city or town from recovering the forfeiture provided in said section nine from the date of the service of the original notice, unless the order is annulled by the jury. • Section 8. If an owner, lessee or mortgagee in possession of such unsafe structure refuses or neglects to comply with the requirements of such notice within the time limited, and such structure is not made safe or taken down as therein ordered, or made secure, a careful survey of the premises shall be made by a board consisting in a city of the city engineer, the head of the fire department, as such term is defined in section one of chapter one hundred and forty-eight, and one disinterested person to be appointed by the local inspector, and in a town of a surveyor, the head of the fire department and one disinterested person to be appointed by the local inspector. If there is no city engineer in such city or no head of the fire department in such city or town, the mayor or selectmen shall designate one or more officers or other suitable persons in place of the officers so named as members of said board. A written report of such survey shall be made, and a copy thereof served on such owner, lessee or mortgagee in possession. Section 9. If such report declares such structure to be dangerous or to be unused, uninhabited or abandoned, and open to the weather, and if the owner, lessee or mortgagee in possession continues such refusal or neglect, the local inspector shall cause it to be made safe or taken down or to be made secure, and, if the public safety so requires, said local inspector may at once enter the structure, the land on which it stands or the abutting land or buildings, with such assistance as he may require, and secure or remove the same, and may remove and evict, under the pertinent provisions of chapter two hundred thirty-nine or otherwise, any tenant or occupant thereof, and may erect such protection for the public by proper fence or otherwise as may be necessary, and for this purpose may close a public highway. In the case of such demolition, the local inspector shall cause such lot to be levelled to uniform grade by a proper sanitary fill. The costs and charges incurred shall constitute a debt due the city or town upon completion of the work and the rendering of an account therefor to the owner of such structure, and shall be MGL Chapter 143 Section 6. The local inspector, immediately upon being informed by report or otherwise that a building or other structure or anything attached thereto or connected therewith in that city or town is dangerous to life or limb or that any building in that city or town is unused, uninhabited or abandoned, and open to the weather, shall inspect the same; and he shall forthwith in writing notify the owner, lessee or mortgagee in possession to remove it or make it safe if it appears to him to be dangerous, or to make it secure if it is unused, uninhabited or abandoned and open to the weather. If it appears that such structure would be especially unsafe in case of fire, it shall be deemed dangerous within the meaning hereof, and the local inspector may affix in a conspicuous place upon its exterior walls a notice of its dangerous condition, which shall not be removed or defaced without authority from him. Upon such notice under either of the preceding sentences, the owner, lessee or mortgagee in possession shall furnish a floor plan of such building or other structure to the chiefs of the fire and police departments of the city or town. Section 7. Any person so notified shall be allowed until twelve o'clock noon of the day following the service of the notice in which to begin to remove such structure or make it safe, or to make it secure, and he shall employ sufficient labor speedily to make it safe or remove it or to make it secure; but if the public safety so requires and if the aldermen or selectmen so order, the inspector of buildings may immediately enter upon the premises with the necessary workmen and assistants and cause such unsafe structure to be made safe or taken down without delay, and a proper fence put up for the protection of passers-by, or to be made secure. The building has been gutted, it looks like the roof has been replaced and the building is not secured. The front door is not locked, the basement bulkhead is gone and most of the windows are out. We received the permit application on August 5th. We have not issued a building permit for the work. I have posted a stop work order. More importantly, the building unsecured and open to the weather. There are unsecured ladders and piles of building materials and demolition debris on the property. It presents a serious life safety hazard. In accordance with the Massachusetts Residential Building Code, section R115 and M.G.L. c. 143, §§ 6, 7, 8, 9 and 10, I am notifying you and ordering that the building be made safe by noon tomorrow, August 10, 2013. I have attached an excerpt from the statute. If the property is not secured by 12:00 noon August 10, 2013, I will cause the property to be secured. The state defines "Homeowner" as, " Person(s) who owns a parcel on which he/she resides or intends to be, a one or two family dwelling, attached or detached structures accessory to such use and/or farm structures. A person who constructs more than one home in a two- year period shall not be considered a home owner." The building department for the City of Northampton wants any person(s)who seek to use the home owner exemption, to act as their own construction supervisor, to be aware that by doing so you become responsible for compliance with state building codes and regulations. The inspection process requires that the building department be called to inspect work at various stages, which include foundation/footings (before backfill), sonotube holes (before pour), a rough building inspection (before work is concealed), insulation inspection (if required) and a final building inspection. The building department requires these inspections before the work is concealed, failure to secure these inspections can result in failure to obtain a certificate of occupancy until the work can be inspected. If the homeowner hires other trades to perform work (electrical, plumbing & gas) the homeowner will be responsible to make sure that the trades hired secure their proper permits in conjunction to the building permit issued, and that they get their required inspections.
