CONDITION OF APPROVAL:
1)The original condition #1 is deleted and replaced with the following:
Prior to issuance of a Building Permit, the applicant shall record an easement benefiting the property
to the south (MapID 24B-038) to become effective when a reciprocal easement with property owners to
the south has been recorded. The proposed fence in the easement access area shall be opened to the
south at such time that the owner to the south records a reciprocal easement for the subject parcel.
All other conditions of the original permit stand as issued on 12/18/2012.
FINDINGS:
Upon hearing from the applicant the unresolved issues over a reciprocal easement with the abutters to the south and upon hearing about
the lengths to which the applicant has attempted to abide by the original condition 1, the Planning Board voted to amend the original
permit condition 1 by deleting it and replacing it with the condition herein.
