The work authorized hereunder shall be completed within three years from the date of this Order unless either of the following apply: (a) the work is a maintenance dredging project as provided for in the Act; or (b) the time for completion has been extended to a specified date more than three years, but less than five years, from the date of issuance and both that date and the special circumstances warranting the extended time period are set forth in this Order. 5. This Order may be extended by the issuing authority for one or more periods of up to three years each upon application to the issuing authority at least 30 days prior to the expiration date of the Order. 8. Any fill used in connection with this project shall be clean fill, containing no trash, refuse, rubbish or de- bris, including but not limited to lumber, bricks, plaster, wire, lath, paper, cardboard, pipe, tires, ashes, refrigerators, motor veNCles or parts of any of the foregoing. 7. I/ 06 July 1987 Howard, Enquire Date 06 July 1987 Date 4 -2 PROJECT DESCRIPTION The applicant has a small pond on its premises on River Road in Leeds, Massachusetts. Within the pond is a standpipe leading to a fire hydrant. The proposed project consists of: 1. The drawdown of the pond, and 2. The cleaning of any debris or vegetation on the pond bottom which may be impeding the flow of water into the standpipe. Maintenance of the pond, standpipe and hydrant is required by the applicant's insurance carrier as a condition of insurance coverage. The Northampton Fire Department recently tested the hydrant but found the flow to be inadequate. It is believed that the inlet to the standpipe is blocked by debris, silt, or vegetation. To accomplish the drawdown, the applicant plans to pump water from the pond into a culvert which runs under River Road and into the Mill River. The applicant will take whatever steps are necessary to prevent erosion of the river bottom and bank which could result from the increased flow through the culvert. Upon completion of the drawdown, the applicant will clean out any debris or other obstructions to the standpipe inlet and allow the pond to refill. There will be no excavation of the Pond beyond that necessary to clean the standpipe. Driscoll, Fire Chief DATE: July 6, 1987 RE: Berkshire Electric Fire Pond On June 30 this Department conducted the annual fire -flow test on the fire pond at Berkshire Electric Cable Co. on River Road, Leeds. It was found that the available water flow was only about 600 G.P.M. The flow should be at least 1000 to 1200 G.P.M. In previous years we have not had this problem. I did note that there is a large amount of reeds and other vegatation around the edges of the pond. My opinion is that the problem could be either from debris around the suction inlet of the pipe or there could be an air leak in the dry hydrant or piping system, In either case, the problem must be eliminated so that the required fire flow can be obtained. The pond will have to be drained to accomplish a remedy for the water problem. There is a hydrant from the city water main available at the site but because the hydrant is near the end of the city main there is not enough pressure or volume to supply water for both fire- fighting and a source for the shop sprinkler system. The determination was made many years ago by insurance underwriters and the recommendation of the Fire Department that the available water in the city main should be alloted to the sprinkler system. Water for firefighting was and is to be obtained from the fire pond which was built and maintained by Berkshire Electric. From the FENA flood maps, the 100 -year flood elevation at the building addi- tion site is 366.3+ feet. The FEMA flood map indicates that the flood zone extends close to the site. Detailed topography was performed and it was found that the existing /proposed ground elevation is 1 foot to 2 feet above this elevation. It is therefore our opinion that the addition is not within the 100 -year FEMA flood zone as defined by elevations shown on the FEMA flood maps. 2. From the detailed topography in the area of the addition, it appears that the 100 -year flood waters will not cross River Road for a considerable distance past the location of the proposed building site. Since the front setback is 65 feet, it is our opinion that the project site is outside the limits of the 40 foot flood plain buffer area. From the site plan for the proposed addition, it can be seen that the build- ing will be built essentially at grade. The existing drainage patterns will be maintained and slopes are relatively flat in the construction area. This, combined with only minor amounts of grading, indicates that any erosional effects will be minimal. Although the proposed rooftop will tend to increase peak rates of runoff, its relatively small size (0.065 acres) and the exist- ing condition of the site (semi - impervious hard - packed gravel) will tend to make any changes in peak design flow rates negligable. Comment 113 revised to show area of rooftop equal to 065 acres versus 65 acres on original letter. For Site Plan Approval, we respectfully request the following submmission requirements be waived from Section 10.11.4 of the City of Northampton Zoning Ordinance: (1) 10.11.4.b.2 Location and use of structures within 100 feet of the pro- perty line. Use of all existing buildings has not been shown. (2) 10.11.4.b.3: Existing and proposed building(s) showing setback(s) from property lines. Setbacks are not shown for existing buildings. (3) 10.11.4.b.5 Wetlands, ponds and surface water bodies, as defined under the Wetlands Protection Act, M.G.L. Chapter 131, Section 40 and rules promulgated therein, 310 CMR 10:00. A small pond area (100+ ft. diam- eter) is shown on the plans which has not been evaluated to determine the extent of the resource area. The proposed building addition is approximately 750 feet from the pond area and is well outside the juris- diction of M.G.L. Chapter 131, Section 40 - the Wetlands Protection Act. (4) 10.11.4.b.11, 12, 13, 14, 15 and 17 : There are no proposed new drainage structures, utilities, sewage disposal facilities, sources of drinking water, landscaping, signs, loading and unloading facilities, or proposed screening associated with the building addition. The site plan shows details for existing facilities as defined under 10.11.4.b.11, 12, 13, 14, 15 and 17 for the entire parcel as recorded by a general topographic survey, but this information is not a complete representation of all the above - defined facilities except in the area of the proposed addition, where detailed topographic survey has been performed. Detailed loca- tions of underground utilities for the site have not been determined. (5) 10.11.4.c: No traffic volumes have been calculated since the proposed addition is to upgrade an existing use and not to expand that use. No impact to existing parking or traffic flow conditions is anticipated. The production process entails extruding plastic compounds on to copper conductors and irradiating some finished products. Wastewater from the manufacturing process is primarily contact cooling water; i.e. water flowing across the plastic encased wire to cool the finished product and cooling water from air compressors. Currently, the wastewater is discharged to a drainage swale along the west and south side of the building (see enclosed plans). The drainage swale also receives stormwater from the site. The existing drainage swale discharges to the fire pond. The outlet from the fire pond flows northerly to a culvert under River Road which discharges to a wetland east and south of the culvert. Inspection of this wetland area indicates that it is landlocked and does not have a direct hydraulic connection to the Mill River (there is no defined discharge channel connecting the wetland to the river) except under high flow conditions (extreme storm events). Previous study by Huntley & Assoc (1989) indicates that site areas below elevation 364 (south of building) and below elevation 365 (south of parking lot) are bordering land (to Mill River) subject to flooding during the 100 -year storm event. Proposed Site Improvements The proposed site improvements include construction of an industrial sewer connection that includes a 5,000 gallon pump tank, meter -box and connective piping. This project will remove industrial wastewater discharges (primarily contact cooling water) from the existing drainage swale and associated wetlands. The proposed facilities will be buried or at- grade. No significant change to existing site grades are anticipated; i.e. there will be no impact on flood storage for 100 -year flood. The proposed location of the pump tank is based on proximity to the existing wastewater discharge -- pipelines and minimizing site impacts. The proposed pressure sewer location, more than 15 -ft from building walls (as shown on plan), is based on: • Minimizing potential conflicts with existing buried utilities (electric, water & gas); • Minimizing potential for wastewater to enter building subgrade drainage & sump; • Minimize intrusion into existing wetland area; • Connection to the existing building sewer (as shown on plan) avoids costs and potential impacts of connecting to the existing sewer in the roadway (avoids traffic disruption, and avoids conflicts with city water transmission line, city water distribution line, and gas line). As shown on plan, the limit of work is defined by the location of the proposed silt fence. Within the wetland area, the proposed silt fence is placed about 8 -ft down - gradient of the pipeline route to provide access for equipment. Excavated soils would be place up gradient of the pipeline route; this provides for any erosion of the excavated soils to flow into the trench and minimizes potential impacts on down - gradient wetland. It is further proposed that this work will be conducted during the winter season, when surface soils are frozen; this will expedite construction and minimize impacts on wetlands. The wetland soils excavated will be used to backfill the same areas of the wetland after pipeline installation. It is anticipated that these soils will regenerate the existing wetland plants without re- seeding. The Owner will monitor these areas and re -seed, if necessary, with a wetland seed mix (as indicated on Plan, note 4). Alternatives The principle alternative is to continue existing wastewater discharges to the swale and associated wetland. This option is less protective of wetland resources and may entail significant monitoring expense. Scientist from Baystate Environmental. Consultants, Inc. (BEC) conducted a site investigation to determine the boundary of State and Local wetland resources pursuant to the Massachusetts Wetlands .Protection Act regulations, 310 CUR 10.00 and the Northampton Wetlands Ordinance. The boundary was demarcated in the field with pink wire stakes and pink surveyor flagging and labeled W -1 through W -9 and B -1 to marls the upper most Bank jurisdiction. Methodoloev and Findings BEC used methodology that is consistent with the DEP handbook for Delineating B VW under the Massachusetts Wetlands Protection Act, 1995. The existing site conditions include an industrial developed parcel that is flanked to the south by a Bank (intermittent channel) and an adjacent Bordering Vegetated Wetland_ Upgradient of wetland flag W -1 the intermittent channel does not appear to meet the definition of a Bank as the channel does not connect two vegetated wetland resources and it does not contain other BVW area throughout the channel. Therefore, we assert that the channel is not regulated as a Bank. Adjacent to the Bank resource a BVW system was delineated along the southeastern portion of the parcel. The BVW also borders on an open water area amociated with a constructed and maintained Fire pond. The ponded area is less than 10,000 S.F; therefore, it does not appear to meet the definition of a Land Cinder Waterbodies and Waterways. However, a Bank resource would be associated with the high water line. The predominant wetland vegetation includes reed canary grass (Phalarris arundinacea), umbrella sedge (Cyperus strigostrs) and Pennsylvania sedge (Carex peiarylva"ira). Along the fire pond margin common cattails (Typha latffolia) is the predominant species_ The principal wetland functional values associated with both resources include flood control, storm damage prevention and wildlife habitat.
