Construct, Inc. has prepared plans for minor renovations at the two -story apartment of Margaret
Humbert-Droz at 50 Union Street, Apartment 19. These renovations are shown on plans Al -A3 and
include five tasks:
1. renovation of upper level lavatory (30 sf)
2. renovation of upper level bathroom (40 sf)
3. expansion of bedroom closet (36 sf)
4. installation of new bookshelves (15 sf)
5. reconfiguration of balcony and installation of new guard railings (60 sf)
Each of these tasks is discreet with the lavatory renovations simple renewal with new compliant
fixtures; expansion of closet is non - structural and installation of bookshelves simple non - structural
work. The reconfiguration of the balcony ( #5) is in response to questionable support at the cable -hung
corner. The open area overlooking the room below will be expanded by removing the questionable
floor structure back to the continuous joists for positive structural integrity. When open, the Architect
will view the existing condition to verify continuous joist support and bring any additional measures
needed to the attention of the Contractor and Building Official. The balcony edge will be protected
with 36" high guardrails using the design provided. This is a minor project with less than 16% of the
apartment constituting work area (181 sf work area; 1188 sf apt.) and the only structural work ( #5) will
result in improved structural integrity and decreased seismic weight. I have reviewed the plans and
visited the site and the plans accurately represent the work and existing conditions. IBC 2009 104.10
allows for omission of full code compliance where the building official finds the modification in
compliance with the intent and purpose of the code; in this case each simple modification clearly
increases the safety, health and welfare of the users. We ask that the Building Official waive the
requirement for construction control in this situation as the work is of a minor nature limited to a small
percentage of the discreet area (which is a small percentage of the building) and will improve health,
safety, welfare, accessibility and structural integrity. Construction Control would be out of proportion
with the standard construction costs and the scale of this project.

11. - Home Owner Exemption
The current exemption for "homeowners" was extended to include Owner - occupied Dwellings of one (1) or two(2) families
and to allow such homeowner to engage an individual for hire who does not possess a license, provided that the owner acts
as supervisor. CMR 780, Sixth Edition Section 108.3.5.1.
Definition of Homeowner: Person (s) who own a parcel of land on which he /she resides or intends to reside, on which there
is, or is intended to be, a one or two family dwelling, attached or detached structures accessory to such use and/ or farm
structures. A person who constructs more than one home in a two -year period shall not be considered a homeowner.
Such "homeowner" shall submit to the Building Official, on a form acceptable to the Building Official, that he /she shall be
responsible for all such work performed under the building permit.
As acting Construction Supervisor your presence on the job site will be required from time to time, during and upon
completion of the work for which this permit is issued.
Also be advised that with reference to Chapter 152 (Workers' Compensation) and Chapter 153 (Liability of Employers to
Employees for injuries not resulting in Death) of the Massachusetts General Laws Annotated, you may be liable for person(s)
