Please find enclosed a Request for Determination of Applicability for resurfacing on
Interstate 91 in the City of Northampton. Due to a very limited availability for the project
funding, we are requesting a Public Hearing at your earliest convenience.
The MassDOT Highway Division is an agency of State Government and as such is exempt
from local Conservation Commission by -laws and fees. In order for MassDOT to provide
advertising payment, the newspaper must directly bill the Massachusetts Department of
Transportation, at the address shown below.
In accordance with 310CMR: 10:05(3) (b)1,a Determination of Applicability shall be
issued within 21 days after the date of receipt of a RDA. If within the 21 days you have

Interstate 91 through the City of Northampton consists of 2 travel lanes northbound and 2 travel lanes
southbound, divided by a grass median. The Interstate within City limits crosses over the Oxbow of
the Connecticut River twice, the (eastern branch) Mill River, and 2 streams between Exits 19 and 21.
Wetlands exist bordering the rivers and streams and can be found at many locations to the East and
West of the Interstate. NHESP Habitat extends over the Interstate for approx 7,200 ft through the
Oxbow area, and can be found to the East of the Interstate up to the Hatfield Town Line. The
Interstate is above the FEMA 100 year flood zone elevations and flood zones which are present
through the Oxbow area, along Ventures Field Road, and Old Ferry Road.

Interstate 91 northbound and southbound through the City of Northampton will be resurfaced within
the existing highway pavement, and the paving will be within the existing shoulders, or guardrails. There
is no proposed grading, slope work, or new drainage work as part of this project. The work includes the
following: pavement milling and resurfacing of hot mix asphalt, installing painted pavement markings,
installing hook lock catch basin grates, and installing reflectorized slotted pavement markers.

b. Identify provisions of the Wetlands Protection Act or regulations which may exempt the applicant
from having to file a Notice of Intent for all or part of the described work (use additional paper, if
necessary).
310 CMR 10.58(6)(a) Riverfront Area: Any excavation, structure, road, clearing, driveway,
landscaping, utility line owned by a political subdivision within the riverfront areas in existence
on August 7, 1996. Maintenance of such structures or areas is allowed (including any activity which
maintains a structure, roads (limited to repairs, resurfacing, replacing, but not enlargement) clearing,
landscaping, etc. in its existing condition) without the filing of a Notice of Intent for work within the
riverfront area, but not when such work is within other resource areas of their buffer zones It is
expected that work will not remove, fill. dredge or alter any resource area.
