7. Install new flashing to the rear two chimneys on. the Jackson St. Side of roo #,
S. Pull the shingles back 3 feet on the east side roof just outside the little Attic roof door.
9. Fabricate and install 16 oz, copper ice and snow belt, and shingle 1 or 2 courses along the top.
10. Remove all our roofing debris from the job site and dispose of in a legal land fill.
11. Remove the existing gutters and reinstall under new roofing.
12. Repair damaged gutter above the back door to 293 #2 apartment.

Your latest proposal would require a finding; here's the pertinent ordinance language (my italics):
§ 350 -9.3. Change, extension or alteration of legally preexisting nonconforming structures, uses, or lots.
Legally preexisting nonconforming structures, uses, or lots may be changed, extended or altered as set forth below. If a
use is not eligible under one subsection, proceed to the next subsection.
A. A preexisting nonconforming structure or use may be changed, extended or altered:
(2) As -of -right in a residential district, when said change is from a preexisting nonconforming use to a conforming
residential use, and there are no changes to the exterior of the structure or lot and no new nonconformities are created by
such change /conversion.
(8) With a finding, in accordance with § 350 -9.2, for a proposed change of use.
§ 350 -9.2. Extension and alteration.
A. This Zoning Ordinance shall not apply to structures or uses lawfully in existence or lawfully begun, or to a valid building
or special permit issued before the first publication of notice of the public hearing on this chapter or to any other
exemptions in accordance with MGL c. 40A, § 6. The ordinance shall apply to any change or substantial extension of such
use, to a building or special permit issued after the first notice of said public hearing, to any reconstruction, extension or
structural change of such structure, and to any alteration of a structure begun after the first notice of said public hearing to
provide for its use for a substantially different purpose or for the same purpose in a substantially different manner or to a
substantially greater extent.
B. A finding, as used in this chapter, requires that the Zoning Board of Appeals determine that a change, expansion or
alteration to a preexisting nonconformity will not be substantially more detrimental to the neighborhood than the existing
nonconforming nature of the structure, lot and or use. The Zoning Board may impose conditions as part of approving a
finding.
C. Applications for findings, as allowed in this chapter, shall follow the same procedural requirements as special permit
applications; however, a finding shall be granted upon the vote of a simple majority of the Zoning Board of Appeals.

Please find enclosed another Zoning Permit Application for the currently distressed and vacant
property located at 285 Prospect Street in Northampton. My wife and I recently purchased this
property and plan to renovate it for residential use consistent with applicable zoning code.
I submitted another application on this property, File No. MP1129, which was approved.
However, we now have further thoughts on what we would like to do, thus this new application.
The only substantive change in this new application is to demolish the main building and rebuild,
rather than using its existing walls. This is detailed below.
As in the previous approved application, in this proposal, the front (Prospect St.) paved parking
spaces would remain. The dirt/gravel driveway that goes through the rear would be replaced with
a grass yard.
The Plan:
- Renovate the existing building marked "C" in the accompanying sketches (the small building,
former restaurant) using existing walls with no change to the size or footprint
- Demolish the existing building marked "A" and `B" plus Sheds in the accompanying sketches
(the main structure, former ice cream factory)
- Rebuild using the same footprint
- Plus a second story directly over the entirety of Section B, for an additional estimated 1650
square feet.
- To make a single residence for personal use.
