At a meeting held on July 18, 1985, the Zoning Board of Appeals of
I the City of Northampton voted unanimously to grant the Variance request
1 of Mr. & Mrs. William Goggins, 71 Gleason Road, Northampton to construct
an attached breezeway /garage onto their dwelling (URB Zone). Present and
voting were: Chairman Robert C. Buscher, William Brandt and Peter Laband.
The findings were as follows:
W. Brandt, referring to criteria necessary to grant a Variance
from Chapter 40A, MGL, found that although the applicants' representa-
tive argued that the lot was unique because it was one of a few homes
on the street which did not have a garage, after a site visit, dis-
agreed, as many homes on that end of Gleason Road do not have a
garage. However, he did find that the structure was unique, in that
it has substantially smaller living space than other homes; that he
concurs with the argument for hardship due to the number of recent
break -ins and the applicants' desire to protect their automobile,
which is a large investment; and that the requested use would not be
of detriment to the public good nor derogate from the intent of the
Ordinance.
P. Laband concurred, finding the structure unique because of its
smallness; that a hardship is involved because of the necessity of
protecting their car and for the convenience of driving in winter -
time; and that the requested use would not be of detriment to the

approximately the same size as others on the street, the house itself
is very small, which constitutes a uniqueness. He also found that
the other houses on the street, which have an attached breezeway

enough of a hardship in the convenience to the applicants in winter

STATEMENT IN SUPPORT OF APPLICATION MAY 1 1935
FOR VARIANCE BWUOM NSPECTiONS �!
MA. 01060
Most of the homes in the particular zoning district already
have a garage attached to their homes and several already have
both breezeway and garage attached. Therefore the proposed
variance would not have a negative effect on the neighborhood,
rather the proposal would add to the overall appearance of the
neighborhood.
Furthermore, the proposed breezeway would provide additional
living space in a home that is only 780 square feet. This
proposal would bring our home more in line with the majority of
the homes in the neighborhood. The relief sought therefore would
clearly not be a sustantial detriment to the public good.'
Indeed, if the "public good" includes consideration of the
general appearance of the neighborhood, the proposal could more
appropriately be labeled as an asset to the public good.
The applicants could suffer substantial hardship through a
literal enforcement of the side lot restriction because said
restriction, when applied to the location of the applicants' home
within their lot would effectively bar the applicants from
constructing an adequately sized garage on their property. The
inclement New England weather conditions virtually demand a
garage in order to preserve the condition of one's automobile.
In addition, the applicants suggest that as a result of a number
of recent house breaks in the neighborhood, the need for a garage
and breezeway, as a means of preserving and protecting one's
private property becomes apparent.
The proposal if approved would result in a reduction in the
amount of side lot footage on one side of the lot. It
would,however, still allow for a seven foot setback on the side
of the lot that is affected. The proposal, thus, affects only
one of the four sides of the applicants' lot. Three sides of the
