ASSISTANT CITY SOLICITOR
On September 15,1976, the Zoning Board of Appeals for the City
of Northampton, decided to grant the petition of FPM, Inc. for a
special permit to convert an existing building at 216 North King
Street to conduct a banking business.
Based upon evidence presented to the Baord, the Board made the
following findings:
1. The use requested is listed in the Table of Use Regulations
as a special permit in the district for which application is
made, or is so designated elsewhere in this Ordinance. See
Chapter 44, Article V, Retail Service Commercial #13, page 5 -10.
2. The requested use bears a positive relationship to the public
convenience or welfare. The public shall have a convenient
location of which to bank; the data processing facility to be
located there shall provide an annual payroll of $350,000,
and the area will be landscaped to improve the general
appearance of the premises.
3. The requested use will not create undue traffic congestion, or
unduly impair pedestrian safety. Directional signs will be
used to regulate egress and ingress from King Street. King
Street is presently a congested public way; however, the
proposed use will not cause any noticeable increase in traffic
over and above the traffic generated by the prior use as a
restaurant. There are 95 parking spaces available on the
premises, and because of that, no cars will have to be
parked on King Street.
4. The requested use will not overload any public water, drain—
age or sewer system or any other municipal system to such an
extent that the requested use or any developed use in the
immediate area or in any other area of the City will be un—
duly subjected to hazards affecting health, safety, or the
