August 18, 2011 Northampton Conservation Commission 210 Main St., Rm. 11, City Hall Northampton, MA 01060 Re: Chesterfield Road driveway MA -DEP # 246 -0655 To the Conservation Commission: In response to comments from the DEP in their August 3, 2011 project review letter, we offer the following responses: The longitude and latitude provided in the application refers to the subject property and may not directly correspond to the exact location of the work subject to regulation. The entire property encompasses roughly 47 acres so some variance between the USGS locus plan and the latitude /longitude is possible. 2. The bordering vegetated wetlands were delineated by Ward Smith of Wendell Wetland Services utilizing both vegetation and hydrology as outlined in the Regulations at 310 CMR 10.55 and in the DEP handbook Delineating Bordering Vegetated Wetlands Under the Massachusetts Landscape Architecture Wetlands Protection Act (1995). The BVW delineated and subject to regulation contains 50% or more of wetland indicator plants and was thus Civil Engineering used as a delineating methodology. Due to the above conditions and in Planning conformance with 310 CMR 10.55(2)(c)1, no Field Data Form were provided. Land Surveying 3. The 110 square feet of wetland alteration represented a conservative area of disturbance associated with the replacement of the existing culvert, construction of headwalls and associated grading for the new driveway as shown on the plans. Additional attention to this area was considered resulting in a design change which eliminates the headwalls and only replaces the existing 10" D.1. culvert with a new 12" D.I. culvert in the same location. The reduction of work has resulted in a decrease in altered area within BVW to only 13 square feet. This is necessary for the blending of grades at the culvert location. See attached SK -1.0. 4AIIenPlace Northampton, Massachusetts 01060 Telephone(413)592 -7000 Facsimile(413) 582- 7005 E -mail hd�Cn�herkshiredesign,cui7i The applicant would like to for the issuing authority to consider the 13 square feet of altered BVW to be considered under section 310 CMR 10.55(4)(c) which allows for the loss of up to 500 square feet of BVW. The disturbed area falls within a portion of wetland that is distinctly "finger- like." The reduced scope of work also minimi disturbance at the existing crossing to extent possible. All other crossing options will result in far greater disturbance to BVW since this is the only culvert location. Should the issuing authority dismiss that assumption, any altered BVW area will be replicated at a 1 to 1 ratio in the same general area and will be constructed in full conformance with CMR 310 10.55(4)(b), 4. If wetland replication area is required, annual monitoring requirements will be provided at the request of the issuing authority in conformance with 310 CMR 10.55(4)(b). As discussed under # 3 and #4 above, if wetland replication is required, the project will meet the requirements of Massachusetts Inland Wetland Replication Guidelines which require a 1 to 1 ratio of disturbed to replicated area. b. The purpose of the existing culvert is to maintain a hydraulic connection between the two adjacent BVW's. There is no Bank or other resource area associated with the crossing. 7. It is expected that the new culvert will be kept clean and clear of debris that could potentially prevent the hydraulic connection from being maintained. In addition to the responses provided above to comments made by the DEP, we would also like to respond to the fact that the project as proposed does not comply with the setbacks contained in the Northampton Wetland Regulations, The Northampton Zoning Bylaw contains requirements for maximum slope of a driveway (10 %) and the Northampton Fire Department fire trucks have a minimum turn radius of 40'. These requirements were instituted primarily to ensure access to home sites by emergency equipment. In a case such as the current one, where an existing site is steeply sloped, these requirements serve as a significant constraint on development of the site. Response to Comments — August 18, 2011 Chesterfield Road Driveway Page 2 of 3 A number of possible driveway alignments were analyzed to determine 1) if they meet the applicable zoning and fire department requirements, and 2) the amount of grading that would be required along with the cut and fill implications of that grading. With the exception of the proposed alignment, significant cut, including blasting of ledge, would be required to construct the driveway. Although these alternatives would reduce the work within the 50' buffer zone, they would create a much larger overall impact forth the work and would likely be cost prohibitive. In order to minimize site disturbance, the first part of the new driveway was designed to follow an existing dirt road, which is within the fifty foot no disturb zone of BVWs located on the project site. By following this route, overall development impacts of the driveway construction are reduced. It is true that the initial portion of the driveway will be within the 50' buffer zone that was established under the local bylaw. However, this route respects zoning and fire department requirements, creates a driveway that works with, rather than against, the land, and results in significantly reduced overall impacts to the project site. The lower section of the driveway at Chesterfield Road shall be graded so that runoff from the driveway will sheet flow off the roadway to the drainage ditch and not to Chesterfield Road. Landscape Architecture Civil Engineering Planning Land Surveying To: Northampton Conservation Commission From: Jeff Squire Re: Chesterfield Road Drive MA -DEP 246 -0655 Date: October 6, 2011 Commission Members- This memo is a follow -up to the public hearing on August 25 2011 regarding the single family drive proposed off Chesterfield Road. At that meeting, the Commission requested alternative driveway alignments to help evaluate the areas of potential disturbance associated with each option. Five alternative alignments which were suggested by the Commission are included with this memo for your review. The alignment that is currently proposed came about from a careful analysis of other alignment options and an effort to minimize disturbance to the bordering vegetated wetland, the buffer zones (50' 100'), and to the existing hillside that extends beyond the buffer zone. Since vegetation removal and re- grading of the hill outside of the buffer zone could have a significant impact to the down gradient resource areas, we felt that the proposed alignment resulted in the least amount of new disturbance. Also please note that each of the alternatives attached does not include retaining walls, stormwater management controls, or vegetated swales as shown in the current proposal plans.
