will be able to review the Chesterfield Road drive NOI. The issues identified below must be addressed by Friday, August 5 in order for the hearing to be advertised for the August 25
Commission meeting. The local application form notes that a replacement culvert will be required, but this is not noted in the narrative or WPA form 3, and no details were provided.
Is the replacement crossing subject to the stream crossing standards? The application indicates that the project is eligible to be treated as a limited project; driveway crossing.
As such, the project also falls under category 2f, “Construction of each crossing for a driveway associated with an unattached single family house, reviewable under 310 CMR 10.53(3)(e),”
for which the application fee is $500. The WPA form 3 indicates 110 sf of alteration to BVW. The location of this alteration was not clear from the plans or narrative More information
is needed about how the project meets the performance standards of the Northampton Wetlands Ordinance. The stream crossing portion of the driveway at Chesterfield Road is a limited project.
The Ordinance 337-10E 2 provides that “The Commission shall not permit alteration within resource areas or their associated protected zones, subject to the following exceptions.” The
crossing portion of the project qualifies for exception (c) as a limited project, under 310 CMR 10.53 (3) e. However, the remaining portion of the proposed driveway is not a limited
project, as it exceeds the “minimum length and width acceptable to the Planning Board.”
