The applicant may only schedule games at the fields and no practices. 3). The maximum number of games allowed will be 30 or half of the previous season's games. 4). The applicant shall submit a schedule of games to OPD and also make the schedule available to the neighborhood. FINDINGS: The Planning Board granted the special permit for soccer for the Spring 2011 season only based upon the information submitted with the application. The Board found the following criteria in section 10 had been met: (1) The requested use protects adjoining premises against seriously detrimental uses. Limited use of soccer for games only and not practices would reduce the traffic impacts on the surrounding neighborhood. (2) The requested use will promote the convenience and safety of vehicular and pedestrian movement within the site and on adjacent streets, minimize traffic impacts on the streets and roads in the area. The permanent speed board helps drivers monitor speeds. Reduced game schedule minimizes total volume; and (3) The requested use will promote a harmonious relationship of structures and open spaces to the natural landscape, existing buildings and other community assets in the area; and (4) The requested use will not overload, and will mitigate adverse impacts on, the City's resources including the effect on the City's water supply and distribution system, sanitary and storm sewage collection and treatment systems, fire protection, streets and schools; and (5) The requested use meets any special regulations set forth in this chapter (none applicable; and (6) The requested use bears a positive relationship to the public convenience or welfare. The use will not unduly impair the integrity of character of the district or adjoining zones, nor be detrimental to the health, morals, or general welfare. The use shall be in harmony with the general purpose and intent of the ordinance; and (7) If applicable, the requested use will promote City planning objectives to the extent possible and will not adversely effect those objectives, as defined in City master or study plans adopted under MGL c. 41, § 81C and 81D. Use of the soccer fields can, in.my opinion, be considered as accessory to the recreational use of the marina. The City of Northampton Zoning Ordinance, Chapter 350, §5.3 states "any use which is accessory to a principal use allowed by special permit, and which is not specifically included in the original special permit, shall be allowed only after issuance of a new special permit ".Soccer or other related sports activities were not specifically included in the . variance granted in 1975 allowing the construction and operation of the marina. It is my determination that use of the marina facilities for soccer requires a special permit from the Northampton Planning Board. Feel free to contact me if you have any questions.
