19. The work associated with this Order(the "Project ") is (1) r is not (2) F subject to the Massachusetts Stormwater Standards.
.If the work is subject to Stormwater Standards, then the project is subject to the following conditions;

with the construction period pollution prevention and erosion and sedimentation control plan and, if applicable, the
Stormwater Pollution Prevention Plan required by the National Pollutant Discharge Elimination System Construction General
Permit as required by Stormwater Standard 8. Construction period erosion, sedimentation and pollution control measures and
best management practices (BMPs) shall remain in place until the site is fully stabilized.
b) No stormwater runoff may be discharged to the post - construction stormwater BMPs unless and until a Registered
Professional Engineer provides a Certification that: i. all construction period BMPs have been removed or will be removed by
a date certain specified in the Certification. For any construction period BMPs intended to be converted to post construction
operation for stormwater attenuation, recharge, and/or treatment, the conversion is allowed by the MassDEP Stormwater
Handbook BMP specifications and that the BMP has been properly cleaned or prepared for post construction operation,
including removal of all construction period sediment trapped in inlet and outlet control structures; ii.. as -built final construction

responsibility for BMP maintenance. Prior to requesting a Certificate of Compliance, or Partial Certificate of Compliance, the
responsible party (defined in General Condition 19(e)) shall execute and submit to the issuing authority an Operation and
Maintenance Compliance Statement ( "O &M Statement ") for the Stormwater BMPs identifying the party responsible for
implementing the stormwater BMP Operation and Maintenance Plan ( "O &M Plan") and certifying the following: i.) the 0 &M

The following treatments are intended to improve the wetland resource located on this property,
and to enhance the wildlife habitat on this field /wetland buffer. Currently, a narrow shrub /tree
buffer exists along the edge of the existing hayfield and the abandoned beaver pond. Much of
the vegetation that occurs in this buffer is exotic - invasive plants that out - complete native plants
and provide little or no habitat value. The goal for the treatments in this area is to convert this
buffer to a healthy natural condition, with all native vegetation that provides a substantial habitat
value. Treatments will be conducted over the next few years to implement this conversion and to
ensure that the native plant population becomes established.
2010 Management Practices
Mowing /herbicide treatment of exotic - invasive plants Spring 2011
The first step in this program will be to remove the larger exotic - invasive plants in this field
buffer, so that room can be opened up for the native plants. A mowing deck mounted on a
Bobcat -style machine will be incorporated to conduct this mowing. This machine will mulch the
cut vegetation so that it lies flat on the ground, and will quickly become incorporated as soil
organic matter. The cut stumps will be directly treated with herbicide to prevent re- sprouting
from the root systems of the plants. Damage to adjacent native vegetation will be avoided with
this direct application approach. Where native vegetation occurs very close to exotic - invasive
plants, the invasives will be cut with a chainsaw, and the cut surface will be treated with
herbicide. Mowing will only occur in the upland field buffer, and will not occur where exotic -
invasive plants exist within the wetland area. Exotic - invasive plants within the wetland will be
cut with a chainsaw, and lopped to lie low to the ground.
Exotic - Invasive Control
Summer 2011
The next step in this program will be to control smaller exotic - invasive plants as well as any re-
sprouts that occur on the plants that were cut in the mowing phase of this project. A foliar
treatment with backpack sprayers will be implemented to control the small individuals with
ultra -low volumes of herbicides. This approach will allow for the protection of native vegetation
and for good control of the exotic - invasives on the site.
Shrub Planting Fall 2011
Following the exotic - invasive control treatments above, a planting of native shrubs will be
completed in the fall of 2011. This planting will incorporate native shrubs with
recommendations from MA Division of Fisheries and Wildlife for the species to be used in these
habitat conditions. Some possible candidates for shrub species include winterberry, Red osier
dogwood, Sweet pepperbush and elderberry. At least three shrub species will be used in this
planting to provide more diverse habitat benefit and a better aesthetic of the resulting field
border. Most of the planting will be completed in the upland field border. Some individuals
may be planted within the abandoned beaver pond wetland area, along the edge of the upland
buffer. Plants will be 3 -5 feet tall when planted, transferred from 1 gallon containers. Plants will
likely be delivered to the planting sites with a pickup truck that will remain in the hayfield
portion of the property. Any work done in the wetland area will be done with hand tools and no
motorized equipment. It is estimated that approximately 90 shrubs will be planted along this
wetland buffer.
Follow -up treatments of exotic - invasive control Summer 2012,2013
In order to ensure that the native shrubs become established, and that no exotic - invasive plants
re- invade this area, follow -up foliar herbicide treatments will be conducted for an additional two
years. These treatments will be conducted with backpack sprayers in order to obtain excellent
control of the invasive plants and to provide selective control with very little adverse impact on
native vegetation. It is expected that very little herbicide will be used in these treatments, as the
populations of invasive plants is expected to be low, and the size of the target plants should be
small.
General WHIP Application Information
This property is currently being managed to produce agricultural products, forest
products, and to provide a diversity of wildlife habitats, and these practices are recommended in
order to enhance the existing habitats. These recommendations will help to restore populations
of declining wildlife habitats. The shrubland and riparian forest buffer habitats created will
provide a permanent benefit in these areas, with appropriate maintenance and monitoring.
Invasive plants will be controlled in this effort to maximize the wildlife habitat benefit, and to
prevent seeds from this area from being transported by wildlife to other properties.
The southern part of the project occurs within BioMap Core Habitat. The entire property
occurs within BioMap Supporting Watershed. This property is a part of a large forest block,
with significant acres of protected open space. Fitzgerald Lake Conservation Area occurs within
500 feet of the eastern and southern boundary of the property. This conservation area contains
over 450 acres of protected open space.
This project will help to provide good wildlife diversity on this property as well as to
enhance the surrounding ecosystem. Native shrublands will enhance the existing forest land and
open field, providing habitat for many declining species. By controlling the invasive plants, the
habitat created here will be more likely to succeed over time, and will not play a role in aiding
the spread of invasive plants in this region.
Herbicide information
All herbicides used in the above treatments are included on the Massachusetts
Department of Agriculture Rights -of Way Sensitive Area Materials List. Cut surface treatments
will be conducted with Garlon 4 and Escort. Foliar treatments will be conducted with either
Garlon/Escort mix (for bittersweet areas); or Accord/Escort/Arsenal mix (for areas without
bittersweet). All herbicide applications will be conducted by MA licensed applicators, and will
follow the Rights -of Way regulations regarding the application of herbicides. No regulations
exist in Massachusetts specifically relating to control of exotic - invasive plants, but the Right -of-
Way regulations are the closest thing that exists to treatments of this nature. By following these
regulations, we can help to ensure that the wetland resources in this area are not adversely
impacted by this project.
