The DPW and the VA Medical Center, Northampton, MA hereby agree that Specific Permit Condition #1 as defined.in the Stormwater Management Permit Decision issued to the VA Medical Center by the DPW for the VA Medical Center Landfill project dated June 17, 2008 shall be completed by the VA Medical Center prior to June 30, 2010. Please note that prior to the start of construction, the final Stormwater Pollution Prevention Plan (SWPPP) must be submitted to the DPW for approval according to Specific Permit Condition 2 of the Stormwater Management Permit. Northampton Conservation Commission ATTACHMENT A MassDEP WPA Form 8A Request for Certificate of Compliance Introduction This document serves as Attachment A to the Massachusetts Department of Environmental Protection (MassDEP) WPA Form 8A – Request for Certificate of Compliance, and was prepared by Advanced Environmental Solutions, Inc. (AES) on behalf of the Department of Veterans Affairs, VA Medical Center, Northampton, Massachusetts (VA – Northampton). The purpose of this document is to address the requirements of Section A.6 of Form 8A, which requires a statement certifying substantial compliance with approved plans, as well as a description of any deviations from the plans. On May 12, 2008 the VA Medical Facility, located at 421 North Main Street in Leeds, Massachusetts, received approval from the MassDEP to perform a permanent closure of the landfill located adjacent to the VA facility. The landfill, originally opened in the 1920’s and used until the 1970’s, contains primarily construction and demolition debris. The landfill occupied approximately 3 acres of a 182 acre parcel of land. This 182 acre parcel was transferred to the Smith Vocational and Agricultural School in 1958. However, the VA Medical Facility remains as the responsible party for all landfill-related issues. In conjunction with the closure application to MassDEP, the VA also filed related permit applications to the appropriate agencies, including a Notice of Intent (NOI) to the Northampton Conservation Commission (ConCom). Subsequent to the NOI filing, the ConCom issued a WPA Form 5 – Order of Conditions on February 28, 2008, which requires submittal of a written request for a Certificate of Compliance upon construction completion. Description of Completed Work and Deviations from Approved Plans Based on my oversight of construction activities, and review of the plans and as-built drawing, I have determined that the construction activities were conducted in substantial compliance with the plans. During landfill closure construction, the following field modifications to the design plans were implemented. None of the modifications presented below were anticipated to adversely affect the integrity of the closure construction. Due to a lower volume of waste requiring relocation to within the revised landfill footprint, final landfill cap grades were lower than anticipated. Despite final grades being lower than anticipated, the required minimum 5% top slopes, and maximum 3 horizontal to 1 vertical (max 3H:1V) side slopes were maintained as required. Since 8-inch diameter reinforced concrete pipe (RCP) was not available at the design- specified diameter, 8-inch diameter corrugated high-density polyethylene (HDPE) pipe was used as the outlet piping from the two drainage structures in the detention basins. DEP WPA Form 8 Attachment A Clay seepage stops were used in place of the concrete stops as noted in plan specifications. Given the corrugated nature of the pipe, and expanding properties of the clay, it is anticipated that clay seepage stops will perform better than concrete stops. Due to the lack of asbestos materials encountered during waste consolidation and relocation activities, it was not necessary to construct the asbestos containment areas as proposed in approved plans. It is important to state that, as noted on plan C-3 – Site Design and Grading Plan, the proposed asbestos containment areas were included as a contingency in the event asbestos-containing material (ACM) was encountered. Additional Information Requested by the Northampton Conservation Commission Pursuant to Conservation Commission’s November 10, 2010 e-mailed request for additional information regarding site construction activities including wetland replication, the following is provided. Waste consolidation and the associated wetland alteration and replication were performed in accordance with the approved plans contained within the January 2008 BWP SW25 Corrective Action Design (CAD) Permit Application prepared by Nobis Engineering, Inc. (Nobis). The CAD, which was also referenced in Section A.8 – Final Approved Plans and Other Documents of the February 28, 2008 Order of Conditions issued by the Northampton Conservation Commission, included the Wetland Replication Area Soil and Seed Mix Detail on Sheet C-4 – Construction Details. Wetland replication consisted of placement of 2-feet of relocated native silty soils, followed by 8-inches of topsoil which was seeded with the approved New England Wetlands Wet Area Mix. The combined total area of replicated and restored wetlands is approximately 14,200 square feet, exceeding the combined permitted alteration and replacement specified in the Order of Conditions. The wetland replication/restoration areas are shown on the as-built drawing prepared by Summit Engineering and Survey, Inc. of Worcester, MA. Construction activities included restoration of the temporary perimeter access road area/bench, which extended 10 linear feet (lf) beyond the landfill cap toe of slope. This work was conducted following completion of fence installation, and consisted of placement and seeding of topsoil. Failure to comply with all conditions stated herein, and with all related statutes and other regulatory measures, shall be deemed cause to revoke or modify this Order. 2. This Order is not final until all administrative appeal periods from this Order have elapsed, or if such an appeal has been taken, until all proceedings before the Department have been completed. 8. No work shall be undertaken until the Order has become final and then has been recorded in the Registry of Deeds or the Land Court for the district in which the land is located, within the chain of title of the affected property. General Conditions Under Massachusetts Wetlands Protection Act 10. Where the Department of Environmental Protection is requested to issue a Superseding Order, the Conservation Commission shall be a party to all agency proceedings and hearings before DEP. 11. Upon completion of the work described herein, the applicant shall submit a Request for Certificate of Compliance (WPA Form 8A) to the Conservation Commission. 12. The work shall conform to the plans and special conditions referenced in this order. 13. Any change to the plans identified in Condition #12 above shall require the applicant to inquire of the Conservation Commission in writing whether the change is significant enough to require the filing of a new Notice of Intent. 14. The Agent or members of the Conservation Commission and the Department of Environmental Protection shall have the right to enter and inspect the area subject to this Order at reasonable hours to evaluate compliance with the conditions stated in this Order, and may require the submittal of any data deemed necessary by the Conservation Commission or Department for that evaluation. 15. This Order of Conditions shall apply to any successor in interest or successor in control of the property subject to this Order and to any contractor or other person performing work conditioned by this Order. 16. Prior to the start of work, and if the project involves work adjacent to a Bordering Vegetated Wetland, the boundary of the wetland in the vicinity of the proposed work area shall be marked by wooden stakes or flagging. Once in place, the wetland boundary markers shall be maintained until a Certificate of Compliance has been issued by the Conservation Commission. 17. All sedimentation barriers shall be maintained in good repair until all disturbed areas have been fully stabilized with vegetation or other means. At no time shall sediments be deposited in a wetland or water body. During construction, the applicant or his /her designee shall inspect the erosion controls on a daily basis and shall remove accumulated sediments as needed. The applicant shall immediately control any erosion problems that occur at the site and shall also immediately notify the Conservation Commission, which reserves the right to require additional erosion and /or damage prevention controls it may deem necessary. Sedimentation barriers shall serve as the limit of work unless another limit of work line has been approved by this Order. 18. All work associated with this Order is required to comply with the Massachusetts Stormwater Policy Standards. Soils exposed for periods greater than two months shall be stabilized with erosion control blai and netting, a covering of straw inulch, or a temporary cover of rye or other grass to prevent erosion and sedimentation.
