On behalf of our client, Thomas E. Borawski we are submitting four (4) copies of a site plan
entitled, Site Plan of Land in Northampton MA, Prepared for Thomas E. Borawski, revision dated
06/22/05, showing the modifications which were requested by the Commission. The following
revisions to the plan have been made; the proposed house and garage have been shirted towards the
roadway so that the minimum zoning front yard setback of thirty feet is held, the proposed house
length has been shorted by five feet and the grading has been altered according to the new house
location. In addition, the grading around the proposed sewage disposal system has been changed
based on soil testing performed by Peter J. McErlain on June 15, 2005. The testing shows the
estimated seasonal high groundwater in the location of the proposed leach field to be approximately
seven feet below existing grade, which allows for the removal of the impervious barrier.

I. Findings pursuant to the Massachusetts Wetlands Protection Act:

Following the review of the above - referenced Notice of Intent and based on the information provided
in this application and presented at the public hearing, this Commission finds that the areas in which
work is proposed is significant to the following interests of the Wetlands Protection Act. Check all that

C. General Conditions Under Massachusetts Wetlands Protection Act
(only applicable to approved projects)
1. Failure to comply with all conditions stated herein, and with all related statutes and other regulatory
measures, shall be deemed cause to revoke or modify this Order.
2. The Order does not grant any property rights or any exclusive privileges; it does not authorize any
injury to private property or invasion of private rights.
3. This Order does not relieve the permittee or any other person of the necessity of complying with all
other applicable federal, state, or local statutes, ordinances, bylaws, or regulations.
4. The work authorized hereunder shall be completed within three years from the date of this Order
unless either of the following apply:
a. the work is a maintenance dredging project as provided for in the Act; or
b. the time for completion has been extended to a specified date more than three years, but less
than five years, from the date of issuance. If this Order is intended to be valid for more than three
years, the extension date and the special circumstances warranting the extended time period are
set forth as a special condition in this Order.
5. This Order may be extended by the issuing authority for one or more periods of up to three years each
upon application to the issuing authority at least 30 days prior to the expiration date of the Order.
6. Any fill used in connection with this project shall be clean fill. Any fill shall contain no trash, refuse,
rubbish, or debris, including but not limited to lumber, bricks, plaster, wire, lath, paper, cardboard,
pipe, tires, ashes, refrigerators, motor vehicles, or parts of any of the foregoing.
7. This Order is not final until all administrative appeal periods from this Order have elapsed, or if such
an appeal has been taken, until all proceedings before the Department have been completed.
No work shall be undertaken until the Order has become final and then has been recorded in the
Registry of Deeds or the Land Court for the district in which the land is located, within the chain of title
of the affected property. In the case of recorded land, the Final Order shall also be noted in the
Registry's Grantor Index under the name of the owner of the land upon which the proposed work is to
be done. In the case of the registered land, the Final Order shall also be noted on the Land Court
Certificate of Title of the owner of the land upon which the proposed work is done. The recording
information shall be submitted to this Conservation Commission on the form at the end of this Order,
which form must be stamped by the Registry of Deeds, prior to the commencement of work.
9. A sign shall be displayed at the site not less then two square feet or more than three square feet in
size bearing the words,

C. General Conditions Under Massachusetts Wetlands Protection Act
10. Where the Department of Environmental Protection is requested to issue a Superseding Order, the
Conservation Commission shall be a party to all agency proceedings and hearings before DEP.
11. Upon completion of the work described herein, the applicant shall submit a Request for Certificate of
Compliance (WPA Form 8A) to the Conservation Commission.
12. The work shall conform to the plans and special conditions referenced in this order.
13. Any change to the plans identified in Condition #12 above shall require the applicant to inquire of the
Conservation Commission in writing whether the change is significant enough to require the filing of a
new Notice of Intent.
14. The Agent or members of the Conservation Commission and the Department of Environmental
Protection shall have the right to enter and inspect the area subject to this Order at reasonable hours
to evaluate compliance with the conditions stated in this Order, and may require the submittal of any
data deemed necessary by the Conservation Commission or Department for that evaluation.
15. This Order of Conditions shall apply to any successor in interest or successor in control of the
property subject to this Order and to any contractor or other person performing work conditioned by
this Order.
16. Prior to the start of work, and if the project involves work adjacent to a Bordering Vegetated Wetland,
the boundary of the wetland in the vicinity of the proposed work area shall be marked by wooden
stakes or flagging. Once in place, the wetland boundary markers shall be maintained until a Certificate
of Compliance has been issued by the Conservation Commission.
17. All sedimentation barriers shall be maintained in good repair until all disturbed areas have been fully
stabilized with vegetation or other means. At no time shall sediments be deposited in a wetland or
water body. During construction, the applicant or his /her designee shall inspect the erosion controls
on a daily basis and shall remove accumulated sediments as needed. The applicant shall immediately
control any erosion problems that occur at the site and shall also immediately notify the Conservation
Commission, which reserves the right to require additional erosion and /or damage prevention controls
it may deem necessary. Sedimentation barriers shall serve as the limit of work unless another limit of
work line has been approved by this Order.
18. All work associated with this Order is required to comply with the Massachusetts Stormwater Policy
Standards.

"ATTACHMENT A"
18. The owner of the property described in this Order must advise any potential buyer of the
property that any construction or alteration to said property, including brush cutting or
clearance, may require approval by the Northampton Conservation Commission.
Any instrument conveying any or all of the owners' interest in said property or any
portion thereof, shall contain language similar to the following:
"This property is subject to the Northampton Wetlands Protection
Ordinance and /or Wetlands Protection Act. Any construction or
maintenance work performed on this property requires an Order of
Conditions, and /or a Determination of Applicability from the Northampton
Conservation Commission.
19. A copy of this Order and associated plans shall remain on site during all construction
and/or building activities. The project manager and all equipment operators shall be
familiar with the approved plans, and shall be informed of their location on the site.
This location shall be accessible to all contractors whenever work is occurring on
site.
20. All required permits must be obtained from the Army Corp of Engineers (Section 404,
Water Quality Certification), Planning Board, Zoning Board, Department of Public
Works, or Building Inspector prior to the start of projects involving fill within any
wetland resource area;
21. No disposal of soils or other materials shall be allowed within: a 100 -year floodplain; 40
feet of the 100 -year floodplain elevation; any wetland; or any area within 100 -feet of a
wetland, unless such areas are specifically approved by the Commission, in accordance
with 310 CMR 10.00, and City of Northampton Ordinances - Chapter 24;
22. All revised plans, referenced within this Order of Conditions, shall be approved by the
Conservation Commission and incorporated into this Order by reference and shall be
followed during the course of construction.
23. Ongoing conditions that shall not expire with the issuance of a Certificate of Compliance
areas follows: N/A
24. Prior to the start of any site work, excavation or construction, a pre- construction
conference shall be held on the site, between the contractor conducting the work, the
site /project engineer, the applicant, and a member or agent of the Conservation
Commission, in order to ensure that the requirements of this Order are understood by all
parties. Prior to the pre - construction meeting, all erosion control devices must be
installed.
25. A permanent limit of no work line shall be marked with granite markers twenty feet on
center at the fifty -foot buffer of the Bordering Vegetated Wetland. No disturbance,
excluding an annual mowing, shall take place beyond the markers.

Thank you for contacting the Conservation Commission regarding a possible extension for the
above - referenced permit. In accordance with the Permit Extension Act, Section 173 of Chapter
240 of the Acts of 2oio, which granted an automatic two -year extension of any permit or
approval that was "in effect or existence" between August 15, 2oo8 and August 15, 2oio, the.
extension permit is now valid until March 27, 2013.
If at that time an additional extension is needed, a request must be filed with the Commission at
least 3o days prior to expiration.

Dear Bob,
I am writing to you on behalf of the Northampton Conservation Commission to formally
request assistance from DEP.
The NCC has before it a Notice of Intent filed by Thomas Borawski and Michelle
Marlow for the construction of a single - family house and septic system, with work being
proposed within the Buffer Zone of a Bordering Vegetated Wetland. The property has
been in active agricultural use for decades. The current owner, Robert Borawski, the
applicant's father, has been leasing the land for farming since 2001 and purchased the
property last year.
An aerial photo of the property taken in 2001 (from MassGIS, state -wide ortho photos)
shows a continuous stream on the parcel, which flows directly into a tributary to the
City's surface water supply. The SCS soils map for the area also shows an intermittent
stream in the same location as that shown in the aerial photo.
The NCC visited the site with the applicant and his representative, Mark Reed of
Heritage Surveys. The existing conditions appear different than the aerial photo from 3
years ago. There is no longer a continuous stream, but rather a segment of stream
directly behind the proposed house site, which flows into a linear BVW, which then
flows again into the tributary. Mr Borawski, the property owner, told the NCC at the site
visit and during the public hearing that he has been plowing through the drainage channel
to plant more crops.
The NCC is concerned that there has been an alteration of a jurisdictional resource area.
Even if the stream was on land in agricultural use, it cannot be filled. The regulations
give an agricultural exemption for the normal maintenance of land in agricultural use, but
a resource area may not be altered without a permit from the Conservation Commission.
Additionally, the regulations for bank resources state, among other things, that any
proposed work shall not impair the physical stability of the bank, the water carrying
capacity of the existing channel within the bank, and only allow for the alteration of 10%
or 50 linear feet, whichever is less.
At the public hearing this past Thursday, October 28, the NCC decided that before it
proceeded with the permit process, it needed to find out what resource areas were on the
site and how much remains. The NCC voted to continue the hearing and formally request
assistance from DEP in this matter.

The applicants are proposing to demolish a large wood barn and a smaller stone barn, along with some
stone retaining walls, and construct a new house, garage and septic system. (Say goodbye to rural
character.)
The proposed house site is a small knoll beside the road and slopes down pretty steeply on the other
three sides to a wet meadow. The rest of the larger original parcel is farmland. There are some existing
trees on the house site, mostly by the slope down to the wetland. The rest of the vegetation is grasses.
THE BIG ISSUE:
• There is a jurisdictional intermittent stream (the channel of which is clearly evident, you can even
see part of it in the topography shown on the plan in the south portion of the lot (the 410 and 411
contours)) running through the wetland and out of an upstream BVW.
• Based on GIS maps, a site visit this morning, and a conversation with Paulette from the DPW, it
appears that this is not a building lot because of a tributary to the public drinking water supply on
this and adjacent properties. No septic systems may be located within 200' (remember Bill
Brandt's lot, also on Kennedy Road and the intermittent stream determination ?)
Other Issues:
• This is a site where erosion into the wetland could be a big issue based on the topography, the
nature of the work proposed and it's proximity to the wetland.
• The NCC policy states that the 20% potentially allowable alteration within the 50 -100' buffer zone
is a cumulative total for the lot. The reserve leach field is located even closer to the 50' buffer.
• The applicant is requesting a waiver of the 20% up front and proposes the alteration of 30 %. This
is better than the "Preliminary' septic design plan at V =30' that was included with the NOI to
show how the work has already been scaled back to 30% alteration.
• Grading is shown butting up to the stone barn which, when I had spoken to the applicant, was to
remain. How do the new contours meet up? Was this additional area of grading calculated into
the 30% alteration?
• The NCC needs some official alternatives analysis standards (maybe a new policy ?) so that when
situations like this arise, you can ask for specific graphic and written things from an applicant to
be sure that there are no reasonable alternatives to the work proposed.
Staff Recommendation:
Ask applicant to file an ANRAD for delineation of all resource areas on the entire property and look at
adjacent City -owned parcel to understand the larger wetland /intermittent stream picture.
This is a continuation from last meeting
The NCC asked for more information from the applicant regarding the historical status of the stream on
the property which was clearly continuous in the aerial photo of 2001, but is no longer so at present.
One of the sources that the NCC asked the applicant to look at was the SCS Soils Maps. The soils map
for the site show a stream that looks just like the stream in the 2001 photo.
Even if the stream was on land in agricultural use, it cannot be filled. The regulations give an agricultural
exemption for the normal maintenance of land in agricultural use, including cleaning out drainage
channels, but a resource area MAY NOT be altered without a permit from the Conservation Commission.
Additionally, the regulations for bank resources state, among other things, that any proposed work shall
not impair the physical stability of the bank, the water carrying capacity of the existing channel within the
bank, and only allow for the alteration of 10% or 50 linear feet, whichever is less. (See 10.53 (4)(a))
Once the Commission suspects that there was an alteration of a jurisdictional resource area on site, it
can't issue a permit.
Staff Recommendation:
• It is reasonable for the Commission to stop the process and try to find out, or have the property
owner look into, what was there and how much of it is left.
• The NCC should formally ask for assistance from DEP in this matter.
