DECISION OF
ZONING BOARD OF APPEALS
The Zoning Board of Appeals of the City of;Norttiampton, at a meeting
held on November 12, 1986, vot•�.d' unanimously,. to..grant the Variance request
of Charles J. Mazeski, Jr., 6 Hayward Rbad;`- �F'foltence, MA, for the purpose
of converting the second floor of an existing, tfucture into two residential
units at property located at 68 Bradford Stree , Northampton,`-.MA. Present
and voting were: Acting Chairman William Brandt, Kathleen M. Sheehan and
Sanford Weil, Jr..
The findings were as follows:'

S. Weil found that as this Board previously approved a similar request
for a Finding for the structure across the street, and as Mr. Mazeski's
structure is situated in a "clearly residential area" (citing the memo
from L. Smith, Planner, on behalf of the Northampton Planning Board,
dated 10/1/86), and in considering the acute need for affordable housing
in the City of Northampton, he would vote in favor of the request, findi
that all of the criteria necessary to grant a Variance have been met.
K. Sheehan also cited the commercial enterprise across the - street
that was allowed to use space for a residential unit and found that
Mr. Mazeski's structure appears as a residential dwelling that fits in
with the surrounding neighborhood. She found his request reasonable,
as the petitioner is burdened with the zoning of this particular area
and voted to approve the Variance request.
W. Brandt found that the structure is unique, as it is the only totally
commercial building on this residential street; that given the fact that
Mr. Mazeski has unsuccessfully attempted to rent this space to commercial
tenants since 1984, a literal enforcement of the Ordinance will cause
• financial hardship to the petitioner; that as this street is clearly
• residential area allowing mixed uses, the requested use will not be of
detriment to the public good; and that the intent of the Ordinance in
relation to this street is unclear. He stated that although he is
normally opposed to granting use Variances, the criteria for a Variance
in this case has been addressed and he would vote in favor.
