At a meeting held on January 29, 1992, the Northampton Zoning
Board of Appeals voted unanimously to GRANT the request of DAVID P.
FOSTER for a SPECIAL PERMIT AND SITE PLAN REVIEW under the
Provisions of § 10.10, 10.11 and 11.9 of the Northampton Zoning
Ordinance, to allow an accessory apartment at 17 VILLONE DRIVE,
LEEDS. Present and voting were Chairman Robert C. Buscher,
Robert Reckman, and M. Sanford Weil, Jr.
The findings were as follows:
1. The board found that all the criteria of § 10.10, 10.11 and
11.9 of the zoning ordinance have been met.
The Conditions are as follows:
1. That the apartment is not rented and that this home remain a
single family residence.
Pursuant to Mass. General Laws, Chap. 40A, §11, no variance,
finding, or special permit, or any extension, modification or
renewal thereof, shall take effect until a copy of the decision
bearing the certification of the City Clerk that twenty days have
elapsed after the decision has been filed with the City Clerk and
that no appeal has been filed, or if such an appeal has been filed
that it has been dismissed or denied, is recorded in the Hampshire
County Registry of Deeds and indexed under the name of the owner of
record or is recorded and noted on the owner's certificate of
title. The fee for such recording or registering shall be paid by
the owner or applicant.
The Northampton Zoning Board of Appeals hereby certifies that a

variance, finding, or special permit has been granted and that
copies of this decision and all plans referred to in it have been
filed with the Planning Board and the City Clerk.
Pursuant to Mass. General Laws, Chapter 40A, section 15, notice is
hereby given that this decision is filed with the Northampton City
Clerk on the date below.
If you wish to appeal this action, your appeal must be filed
pursuant to M.G.L. Chapter 40A, Section 17, with the Hampshire
Superior Court and notice of said appeal filed with the City Clerk
within twenty (20) days of the date this Decision was filed with
the City Clerk.

The Northampton Zoning Board of Appeals met at 8:30 p.m. on January
29, 1992 in Council Chambers, Wallace J. Puchalski Municipal
Building to conduct a public hearing on the request of David P.
Foster for a Special Permit and Site Plan Review to allow an
accessory apartment at 17 VILLONE DRIVE, LEEDS. Present and voting
were Chairman Robert C. Buscher, Robert Reckman, and M. Sanford
Weil, Jr. Also present, in addition to those mentioned above, was
Mary H. Martineau, Board Secretary.
Chairman Buscher read the Legal Notice which was published twice
in the Daily Hampshire Gazette as required. There was one item of
correspondence dated January 29, 1992 from the Northampton Planning
Board which said that at its January 23rd meeting the Planning
Board had voted unanimously to grant the requested site plan
waivers and recommend that the Zoning Board grant the requested
Special Permit and Site Plan Review for an accessory apartment at
17 VILLONE DRIVE, LEEDS.
David Foster said they had already built the two rooms over the
garage and wanted to add a kitchenette. He said he has lived there
for 25 years and was not planning to rent out the space. The
additional rooms are not accessible through the house. There is
only access from the outside. There are stairs on the outside of
the building and two doors into the apartment from the outside. B.
Reckman moved to close the public hearing. s. Weil seconded the
motion which passed unanimously.
Before granting a special permit the members reviewed the criteria
of the zoning ordinance for a special permit and site plan review
which were met by the applicant. B. Reckman moved to grant the
Special Permit and Site Plan Review to allow an accessory apartment
at 17 VILLONE DRIVE, LEEDS, with the condition that the apartment
is not rented and that this home remain a single family residence.
S. Weil seconds the motion which was passed unanimously.
