Dear Mr. Baker:
Yesterday I received an inquiry from a concerned neighbor regarding gravel fill deposited onto
your property located on Bridge Street. Since your property lies partially within the floodplain
of the Connecticut River, any fill including gravel, that is brought into floodplain requires a
permit from the Northampton Conservation Commission under the Massachusetts Wetlands
Protection Act. This ensures that each cubic foot of fill is offset with an equal amount of
material removed. ,~ ,
It appears that the gravel that you have recently placed on site is on the edge of this floodplain
boundary. Under Northampton's Wetlands Protection Ordinance, a permit is required for
activities within the floodplain as well as within 40 of the floodplain. Therefore, you must obtain
a permit for the gravel that you have deposited on your property. Please contact me as soon as
possible, and no later than February 8t'', to discuss whether or not a Request For Determination is
applicable or if a Notice of Intent will be required. For this process you must document precisely
the topography (stamped by an engineer) of the area where the -gravel was deposited, how much
gravel you dumped on site, and how much -if aaiy-material you removed. The Commission
requires that there be no net increase in elevation on the property that could exacerbate flood
conditions there.
I have enclosed an application form for the Request For Determination (to be used if gravel
deposited is above the flood elevation of 125'). Other information regarding the requirements
under the Wetlands Protection Act is on our website: http://www.northainptonplaluzing.org.
If I do not hear from you by February 8, you maybe subject to enforcement action by the
Conservation Conunission.
